The Warsaw District Court has revoked the European arrest warrant against Marcin Romanowski, former Polish Deputy Minister of Justice who fled to Hungary a year ago after being charged with several crimes, including participation in an organized criminal group, and was granted asylum there, his lawyer announced on Friday.
The Polish arrest warrant remains in force against Romanowski, who is currently a member of parliament for the main opposition party, Law and Justice (PiS). Last December, the Warsaw District Court decided to issue a European arrest warrant at the initiative of the Polish prosecutor’s office.
Bartosz Lewandowski, the lawyer representing the wanted politician, announced on Friday on X that the court had approved his appeal and revoked the arrest warrant. The lawyer recalled that Interpol, the international police cooperation organization, had rejected the arrest warrant in April.

At the time, Interpol did not disclose the reasons for its decision, citing the principle of confidentiality. However, according to Lewandowski, the court took Interpol’s reasons for the rejection into account when it decided on Friday to revoke the European arrest warrant.
The lawyer has now published part of the reasoning behind the withdrawal of the European arrest warrant. He said that
the court agreed with him that there were “perceptible attempts at unlawful political influence and violations of civil liberties” surrounding the investigation against Romanowski.
The published excerpt from the reasoning states, among other things, that Hungary is a full member of the European Union, hence “the Hungarian state’s decision to grant asylum has the same legal consequences as any decision made in any other EU member state.”

Referring to the principle of mutual legal assistance between member states and trust in the institutions of other EU states, they stated:
If Hungary has recognized that Marcin Romanowski is being persecuted in Poland for political reasons, then this assessment must be considered to be in good faith and must be fully respected.”
They added that there was no doubt that the decision of the Hungarian authorities was “fully in line with EU and international law.”
In a post published on X, he quoted from the final decision of the Warsaw District Court dated December 19: “The Hungarian state fulfilled all formalities related to granting Marcin Romanowski refugee status: in particular, it notified the Council of the European Union, which accepted this information and did not question it, and then notified the Polish side and all other member states of the European Union.”

Marcin Romanowski was suspected of committing 18 criminal offenses in connection with tenders announced by the Justice Fund operating under the former PiS government’s Ministry of Justice, including causing damage to state property and participating in an organized criminal group.
Przemyslaw Nowak, spokesman for the Polish Public Prosecutor’s Office, called Friday’s court decision “unfounded” on Friday evening and announced further legal action on behalf of the body he represents.
Current Minister of Justice and Chief Prosecutor Waldemar Zurek wrote on X that the prosecutor’s office would not drop the European arrest warrant for Romanowski and would submit a new request for a new European arrest warrant in Poland. “If the case is assigned to the same judge again, they will request his recusal on the grounds of lack of objectivity,” Zurek said.
Speaking to the conservative Polish news channel TV Republika on Friday, Romanowski said that
the court’s new decision was an “indictment” against the current leadership of the Ministry of Justice and the government of current Prime Minister Donald Tusk.
He believes that the Justice Fund case was intended to be used to attack opposition politicians, but the court’s reasoning on Friday “completely refuted this argument.”
